Working with lenders to restructure existing debt is often required whether one is buying or selling. For Individuals

Purchasing, selling, or financing a residence is often one of the largest decisions to be made by a person or family; and such a decision should not be taken lightly or made in haste.  

At Wigder & Diaz, our goal in individual representation is simple and direct. Advise our client’s as we would a member of our own family; not in an impersonal fashion managed by staff, but as a counselor, in a personal and professional manner always managed by an attorney with the understanding in mind that there are often emotional aspects involved in the decision making process.

We expect our clients to ask lots of questions when going through a transaction. Ask questions about the closing process. Ask questions about the obligation to deliver (or receive) “clear title”. Ask about our past experience with a similar property or a similar situation. Keep asking until the transaction is completed. Realtors are the life-blood of the real estate industry and often not only the facilitators of the given transaction but also a center of information and communication. 

At Wigder & Diaz, working with realtors together to achieve the client’s goals is the best way for the deal to close smoothly.

We encourage our realtor “partners” to call us about the deal. Call us to ask questions about a deal or above about real estate in general. Call us to inquire as to the status of the deal and always talk to the attorney managing the transaction. Call to ask questions about title issues. Call to get the closing done.

For Lenders

Florida is in many respects one of the centers of lender activity in the United States. Everyone is aware of the volume of foreclosures, REO properties, and borrowers that are “upside-down”. Accordingly, the completion of lender REO transactions represents an important step in stabilizing lenders balance sheets and proceeding to a better economic environment not only for lenders but for borrowers as well.

Both Marc Wigder and Sarah Diaz have extensive experience in REO transactions and have managed high volume, title intensive legal practices closing REO and deed-in-lieu transactions throughout the State of Florida. 

Working with and constant communication with our REO asset management “partners” is crucial to our lender practice and to a prompt and smooth closing and disposition of the REO assets.

 







For Investors 

Given a market filled with foreclosures, short sales, loan modifications, REO properties, and developer inventory, contractual negotiations and obligations can often differ dramatically based on the circumstance. Financing is often difficult to obtain and is subject to an ever increasing list of conditions. Many properties are “underwater” and working with lenders to restructure existing debt is often required whether one is buying or selling. Cash transactions or private equity sources are more prevalent but are also subject to special circumstances in many instances such as closing in “super” short order or taking the property in its “As Is” condition.  

Our goal in commercial representation is to work within the parameters of a given transaction with all the potential parties involved and doing so in an efficient manner to proceed to a prompt and closing.  We will always attempt to complete a transaction on a flat-fee basis in order for our clients to understand the financial impact to them in any given transaction.
